  3.     License Agreement and Limited Warranty

  5. PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THE 
  6. SOFTWARE. BY USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY 
  7. THE TERMS OF THIS LICENSE AGREEMENT. WE ARE WILLING TO LICENSE 
  8. THE ENCLOSED SOFTWARE TO YOU ONLY ON THE CONDITION THAT YOU ACCEPT 
  9. ALL THE TERMS AND CONDITIONS CONTAINED IN THIS LICENSE AGREEMENT. 
  10. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE AGREEMENT, 
  11. PROMPTLY RETURN THE UNUSED SOFTWARE WITH ALL OTHER MATERIAL 
  12. CONTAINED IN THIS PACKAGE ALONG WITH PROOF OF PAYMENT TO THE 
  13. AUTHORIZED DEALER FROM WHOM YOU OBTAINED IT  FOR A FULL REFUND OF 
  14. THE PRICE YOU PAID.

  16.     BYRON PREISS MULTIMEDIA COMPANY ("BPMC") 
  17.     SOFTWARE LICENSE AGREEMENT
  18.  
  19. 1. GRANT OF LICENSE.    (a) You may install and use the Software 
  20. on the hard disk drive of any single compatible computer you own. 
  21. However, you may NOT under any circumstances have the Software 
  22. installed onto the hard drives of two or more computers at the 
  23. same time; and you may NOT install the Software onto the hard 
  24. drive of one computer and then use the original diskettes on 
  25. another computer. If you wish to use the Software on more than 
  26. one computer, you must either erase the Software from the first 
  27. hard drive before you install it onto a second hard drive, or else 
  28. license an additional copy of the Software for each additional 
  29. computer on which you want to use it.

  31.             (b) The application, demonstration, system 
  32. and other software accompanying this License, whether on disk, in 
  33. read only memory, or on any other media, plus the related 
  34. documentation and fonts, are licensed to you by BPMC. You own 
  35. only the disc or other physical media on which the Software and 
  36. fonts are recorded, but BPMC and/or BPMC's Licensors retain title 
  37. to the Software, related documentation and fonts, as well as any 
  38. copies thereof which may exist.

  40. 2. COPYRIGHT. The Software contains copyrighted material, trade 
  41. secrets and other proprietary material. In order to protect them, 
  42. and except as permitted by applicable legislation, you may not 
  43. decompile, reverse engineer, disassemble or otherwise reduce the 
  44. Software to a human-perceivable form. You may NOT modify, 
  45. network, rent, lease, loan, distribute or create derivative works 
  46. based upon the Software in whole or in part.  You may NOT 
  47. electronically transmit the Software from one computer to another 
  48. or over a network. Nothing in this Agreement constitutes a waiver 
  49. of  BPMC's rights under U.S. Copyright law or any other federal or 
  50. state law.

  52. Please see the document "credits.txt" for additional information 
  53. concerning the copyrights, trademarks, and registered trademarks 
  54. of the properties represented in this product.

  56. 3. OTHER RESTRICTIONS. You may NOT rent, lend, or lease this 
  57. Software. However, you may transfer this license to use the 
  58. Software to another party on a permanent basis by transferring 
  59. this copy of the License Agreement, at least one unaltered copy 
  60. of the Software, and all documentation. You must, at the same 
  61. time, either transfer to the other party or destroy all your 
  62. other copies of the Software. Such transfer of possession 
  63. terminates your license from us. Such other party shall be 
  64. licensed under the terms of this Agreement upon its acceptance of 
  65. this Agreement by its initial use of the Software. If you transfer 
  66. the Software, you must remove all copies from your hard disk and 
  67. you may NOT retain any copies of the Software for your own use.

  69. 4. TERMINATION. This License is effective until terminated. You 
  70. may terminate this License at any time by destroying the Software, 
  71. related documentation and fonts and all copies thereof. This 
  72. License will terminate immediately without notice from BPMC if you 
  73. fail to comply with any provision of this License. Upon 
  74. termination you must destroy the Software, related documentation 
  75. and fonts and all copies thereof.

  77. 5. EXPORT LAW ASSURANCES. You agree and certify that neither the 
  78. Software nor any other technical data received from BPMC, nor the 
  79. direct product thereof, will be exported outside the United States 
  80. except as authorized and permitted by the laws and regulations of 
  81. the United States.  If the Software has been rightfully obtained by 
  82. you outside of the United States, you agree that you will not 
  83. re-export the Software nor any other technical data received from 
  84. BPMC, nor the direct product thereof, except as permitted by the 
  85. laws and regulations of the United States and the laws and 
  86. regulations of the jurisdiction in which you obtained the Software.

  89.     LIMITED WARRANTY
  90.  
  91. Limited Warranty. BPMC makes the following limited warranties, for 
  92. a period of ninety (90) days from the date you acquired the 
  93. Software from BPMC or our authorized dealer:
  94.  
  95. (a) Media. The disks and documentation in this package will be free 
  96. from defects in materials and workmanship under normal use. If the 
  97. discs or documentation fail to conform to this warranty, you may, 
  98. as your sole and exclusive remedy, obtain a replacement free of 
  99. charge if you return the defective disc or documentation to us with 
  100. a dated proof of purchase.

  102. (b) Software. The Software in this package will materially conform 
  103. to the documentation that accompanies it. If the Software fails to 
  104. operate in accordance with this warranty, you may, as your sole and 
  105. exclusive remedy, return all of the Software and the documentation 
  106. to the authorized dealer from whom you acquired it, along with a 
  107. dated proof of purchase, specifying the problem, and BPMC will 
  108. provide you with a new version of the Software or a full refund at 
  109. our election.

  111. (c) WARRANTY DISCLAIMER. BPMC DOES NOT WARRANT THAT THIS SOFTWARE 
  112. WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE 
  113. UNINTERRUPTED OR ERROR-FREE. BPMC EXCLUDES AND EXPRESSLY DISCLAIMS 
  114. ALL EXPRESS AND IMPLIED WARRANTIES NOT STATED HEREIN, INCLUDING THE 
  115. IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR 
  116. PURPOSE.

  118. Some states do not allow the exclusion of implied warranties, so 
  119. the above exclusion may not apply to you. This limited warranty 
  120. gives you specific legal rights, and you may also have other legal 
  121. rights, which vary from state to state.
  122.  
  123. LIMITATION OF LIABILITY.  BPMC'S LIABILITY TO YOU FOR ANY LOSSES 
  124. SHALL BE LIMITED TO DIRECT DAMAGES, AND SHALL NOT EXCEED THE AMOUNT 
  125. YOU ORIGINALLY PAID FOR THE SOFTWARE. IN NO EVENT WILL BPMC BE 
  126. LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, 
  127. INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS) 
  128. EVEN IF BPMC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 
  129. BPMC WILL HAVE NO RESPONSIBILITY TO REPLACE A DISK/DISC DAMAGED BY 
  130. ACCIDENT, ABUSE OR MISAPPLICATION.

  132. Some jurisdictions do not allow these limitations or exclusions, 
  133. so they may not apply to you.
  134.  
  135. United States Government Restricted Rights. The enclosed Software 
  136. and documentation are provided with Restricted Rights. Use, 
  137. duplication or disclosure by the U.S. Government or any agency or 
  138. instrumentality thereof is subject to restrictions as set forth in 
  139. subdivision (c)(1)(ii) of the Rights in Technical Data and 
  140. Computer Software clause at 48 C.F.R. 252.227-7013, or in 
  141. subdivision (c)(1) and (2) of the Commercial Computer Software--
  142. Restricted Rights Clause at 48 C.F.R. 52.227-19, as applicable.
